First Solar drops USITC complaint over TOPCon patents

The Arizona-based thin-film manufacturer withdraws a trade complaint citing federal Section 232 tariffs on polysilicon.

First Solar has voluntarily withdrawn its Section 337 complaint before the U.S. International Trade Commission (USITC), ending an investigation into competitors allegedly infringing on its TOPCon patent portfolio. The company cited recent federal Section 232 actions on imported polysilicon as the catalyst for the decision, arguing the tariffs establish protection at the border and allow First Solar to focus on domestic legal remedies. First Solar does not manufacture TOPCon panels; it acquired the patent portfolio through its 2013 purchase of TetraSun. The withdrawal clears the way for active patent infringement lawsuits in U.S. District Court against several major manufacturers, including affiliates of Canadian Solar, JinkoSolar, and Trina Solar, which had been stayed pending the USITC process.
